The High Court has stopped the swearing in of the tribunal appointed by President Uhuru Kenyatta recently to investigate six members of the Judicial Service Commission.

While giving the judgment, Judge George Odunga said the tribunal cannot sit and no investigations should begin.

The judge further said  said that the court order barring parliament from discussing suspension of the members was still on course.

Last week, President Uhuru Kenyatta has suspended six Judicial Service Commission commissioners. They included Those suspended include  Mr. Ahmednasir Abdullahi, Rev. Dr. Samuel Kobia, Prof. Christine Mango, Mr. Justice Mohamed Wasarme, Ms. Emily Ominde and  Ms. Florence Mwangangi.The president went ahead to form a five member tribunal to investigate the commissioners conduct. The tribunal was to  be chaired by Aaron Ringera and the members included Jennifer Shamallah, Ambrose Otieno Weda and Mutua Kilaka.

This move by the president caused a lot of mixed reactions from the opposition led by former Prime Minister Raila Odinga. Raila faulted the presidents move saying the tribunal formed would dismember the judiciary and leave it as an appendage of the Presidency and the Legislature.

Even as the war continues the question still remains; is the entire process turning out to be a political contest?
